No ELO penalty?

Hi there,
Can you please explain why some people don't get a pentaly when they retire? I once got a penalty when I retired after 2 points, but some people retire at 1-5 down and nothing happens. Can you please explain? Thank you

Here, my opponent retired at 1-4 down in the tiebreak, and I got an ELO penalty! AND, he gained 3 ELO simply for getting to the tiebreak, while I lost 3 ELO, even though he had over 200 ELO higher than me. Please, I would like my ELO back, thank you. And also if you would please explain, thanks!
His name is Vic. Very unfair.

Hello,
what were you doing when your opponent retired ?
If you were not in the game, then it's normal you got the ELO Penalty...

I was in the game when he retired. I was not in another window.
And as for the first post, what's up with that?

During the first 2 games of the match, if you're losing and quit, you'll get a small ELO Penalty. If you lead, you can quit without penalty.
If you're not in game for 40 seconds (ie: swapped to another application, watching menus/replay/stats) then your opponent can quit without penalty.

Since that wasn't the case in eithre of those matches I posted, what is the reason? I was ahead in both, and didn't retire, and was not in the menus.

like this major bug that made me lose around 600 elo points some months ago?
By the way, did the game freeze before he retired?, 'cuz that's how it happened with me.
